1. Booking Deposit

  • To secure a date and time for your session, a 50% non-refundable deposit is required at the time of booking.
  • The remaining balance must be paid before beginning the photo shoot on the scheduled day.

2. Turnaround Time

  • Photos will be ready within 14-21 days after the shoot.
  • If expedited processing is required, this must be discussed and agreed upon in advance, and additional fees may apply.
  • Expedited photo processing is available for an additional fee of 50% of the shoot cost, ensuring you receive fully color-corrected images within 72 hours.

3. Photo Delivery

  • You will receive a link to download your photos, which will be valid for 30 days. Please ensure that you download and back up your images within this period, as the link will expire after 30 days.
  • Link restoration services are available for an additional fee.

4. Rescheduling and Cancellations

  • You may reschedule your session only once for free, and the change must be made at least 7 days before the scheduled session date. Other changes can be made for an extra fee.
  • Any additional requests to change the date, or rescheduling within 7 days, will not be accepted unless due to force majeure, which will be considered on a case-by-case basis.

5. Late Arrivals

  • If you arrive more than 30 minutes late to your session, a $200 late fee will be applied. This fee is necessary to cover the disruption to the schedule and ensure that the session can still be completed without impacting other bookings.
  • The photo session begins at the agreed-upon time and lasts for 75 to 90 minutes. If you are late, the delay will be included in the session duration.

6. Retouching and Editing

  • The cost of the session includes professional retouching for 10 selected photos.
  • Additional photos can be retouched for an additional fee per photo.
  • Basic retouching covers adjustments for lighting, color corrections, and minor blemishes. Any extensive retouching or special requests, such as body reshaping or background changes, will be subject to additional fees.
  • The selection of photos for retouching is provided to the client, and the selection must be made within 3 days after receiving the link to the photos. If no information about the selected photos is provided to the photographer within 14 calendar days, the order will be considered 100% completed, and by default, this means the work is finished. If you require 10 photos for retouching after the selection period (14 days) has ended, the retouching will be done according to the standard price list with an extra fee and based on the photographer’s current timeline.
  • Photos in retouching will be ready within 7 days after the client’s selection (not including the time for revisions). 
  • Clients may request up to 2 free revisions per photo in the final retouch. Any additional edits beyond the 2 free revisions will be subject to an extra charge.

7. Additional Fees

  • If any extra services are required (such as expedited photo delivery), these will incur additional fees, which will be discussed and agreed upon in advance.

8. Force Majeure

  • In the event of unexpected circumstances beyond either party’s control (e.g., natural disasters, emergencies), rescheduling will be allowed without any penalties, provided that the situation is promptly communicated.

9. Copyright and Usage Rights

  • Upon full payment, the client will receive the right to use the final edited images for personal purposes as agreed, commercial purposes of using images should be discussed before usage.
  • BayAreaLife, Inc. reserves the right to use images for promotional purposes unless explicitly discussed otherwise.

10. Liability

  • We are not responsible for any delays, cancellations, or disruptions caused by situations beyond our control (such as weather, equipment failure, etc.).
  • We will ensure that all efforts are made to deliver the service as per the agreed schedule and conditions.
  • We are not responsible for any injuries to the client or damage to property that may occur during the shoot in the event of an accident.

11. Refund Policy

  • Booking deposits are non-refundable.
  • No refunds will be given once the session has been completed and the work has commenced.

12. Model Release and Privacy

  • By agreeing to this contract, the client grants BayAreaLife, Inc. permission to use the images for marketing, portfolio, website, social media, and promotional purposes unless otherwise stated in writing.
  • If the client wishes to keep the images private or off social media, this must be agreed upon in advance and will incur an additional fee of 50% of the total cost of the session.

13. Client Responsibilities

  • The client is responsible for ensuring that all participants of the shoot (if applicable) arrive on time and are prepared (e.g., with appropriate clothing, makeup, etc.).
  • If there are any special requests regarding the session (specific poses, locations, props, etc.), they must be communicated to the photographer before the shoot.

14. Session Duration

  • The agreed duration of the session will be strictly observed. If the session exceeds the allocated time due to delays on the client’s side, additional charges may apply.

15. Weather Policy (for outdoor shoots)

  • If weather conditions are unsuitable for the scheduled shoot (e.g., heavy rain, extreme cold, or other hazards), the session may be rescheduled at no additional cost. The decision will be made in mutual agreement with the photographer.

16. Travel and Additional Costs

  • If the shoot location requires travel, the client will be responsible for covering transportation costs. This includes Uber or any other reasonable transportation service fees to and from the shoot location. These costs will be calculated and communicated in advance.
  • Any additional expenses related to the shoot (e.g., permits, location fees, props, etc.) will also be the responsibility of the client and must be agreed upon before the shoot.

17. Payment Method

  • All payments will be processed through Stripe.
  • Please ensure that payments are made promptly to avoid any delays in the service.
